3. Filing a DMCA Takedown Notice

  2. Identification of the copyrighted work claimed to be infringed, or if multiple works are involved, a representative list of such works.

  4. A statement confirming that you have a good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or the law.
  5. A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

4. Counter-Notice Process

If you believe that content you uploaded or shared was removed in error, you may file a counter-notice. A valid counter-notice must include the following:

  1. Your contact information, including full name, mailing address, email address, and phone number.
  2. Identification of the content that was removed or disabled, and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief the content was removed as a result of a mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the Federal District Court for your judicial district, or if outside the United States, to the jurisdiction of any judicial district in which Fru.i.tion may be found.
  5. Your electronic or physical signature.

5. Actions Upon Receipt of Valid Notices

Upon receiving a valid DMCA takedown notice:

  • Fru.i.tion will promptly remove or disable access to the infringing material.
  • Fru.i.tion will notify the user responsible for the allegedly infringing content, providing them with a copy of the notice.

Upon receiving a valid counter-notice:

  • Fru.i.tion may reinstate the content unless the copyright owner initiates legal action within 10 business days.

6. Misrepresentation

Any individual who knowingly submits a false DMCA notice or counter-notice may be liable for damages under the DMCA. Fru.i.tion reserves the right to pursue legal action against any party that abuses this policy.

Fru.i.tion may update this DMCA Compliance Certification at any time to reflect changes in the law or our practices. Any updates will be posted on our official website or provided upon request.
